HARPERSFIELD — Sheriff Craig S. DuMond announced the arrest of a Middleburg man following his arrest on a Town of Harpersfield Court - Warrant of Arrest.
On January 22nd, 2026, members of the Delaware County Criminal Investigations Division were assigned a complaint in which it was alleged that 32-year-old Mark J. Smith of Middleburg, NY entered into an agreement with a business to pay a fee for the rental of equipment. Smith then used a credit card which he knew was invalid to feign payment of the fee. Despite repeated attempts by the business to collect the rental fees, Smith made no further attempts to pay the fee, which totaled more than $3,000.00.
On Wednesday afternoon, February 11th, 2026, following the receipt of a Warrant of Arrest from the Town of Harpersfield Court, Deputies from the Schoharie County Sheriff’s Office assisted the Delaware County Sheriff’s Office in locating Smith and taking him into custody.
Shortly thereafter, Smith was turned over to Delaware County Sheriff’s Deputies, who arrested and charged Smith with one count of Grand Larceny in the 3rd degree, a class D felony, and one count of Unlawful Use of a Credit Card, a class A misdemeanor, both offenses of the NYS Penal Law.
Upon the conclusion of arrest processing, Smith was turned over to the Delaware County Jail pending arraignment at Centralized Arraignment Part (CAP) Court.
