Fifth Indictment Alleging Bribery and Criminal Contempt in Ongoing Case

DELHI – Delaware County District Attorney Shawn J. Smith announced a new two count indictment against David W. Gensler, 51, of Delhi, on April 2, 2026. 

Gensler remains incarcerated as he was remanded without bail based on felony charges from multiple previous indictments. He will be arraigned on the new charges early next week.

On October 14, 2025, Gensler was indicted on 4 counts including Use of a Child Less than 17 Years of Age in a Sexual Performance, Disseminating Indecent Materials to Minors in the 1st Degree, Luring a Child into a Vehicle/Building to commit a crime, and Disseminating Indecent Materials to Minors in the 1st Degree. 

On October 30, 2025, Gensler was indicted on four additional counts including Rape in the 1st Degree, Stalking in the 4th Degree, Unlawful Imprisonment in the 1st Degree, and Sexual Abuse in the 1st Degree. 

On November 6, 2025, Gensler was indicted on seven charges including False Reporting of an Incident in the 3rd Degree, Offering a False Instrument for Filing in the 1st Degree, Tampering with Physical Evidence and Criminal Conspiracy in the 5th Degree.

On February 19, 2026, Gensler was indicted on six additional charges including Perjury in the 2nd Degree, Tampering with Physical Evidence, Offering a False instrument for Filing in the 1st Degree, Falsely Reporting an Incident in the 3rd Degree, Conspiracy in the 5th Degree and Aggravated Harassment in the 2nd Degree.

On April 2, 2026, Gensler was indicted on two additional charges including Bribing a Witness which is a Class D Felony and Criminal Contempt in the 2nd Degree which is a Class A Misdemeanor. It is alleged that Gensler attempted to pay a witness from a previous indictment not to testify against him in court. It is further alleged that the party had a criminal order of protection against him in place and that this contact violated the order of protection.

After Thursday’s Indictment, Gensler now faces twenty-two charges including two Class B Felonies, four Class D Felonies, nine Class E Felonies and seven Class A Misdemeanors.

Indictments and Criminal Complaints are merely allegations.  All defendants are presumed innocent unless proven guilty.
