20 YEAR PRISON SENTENCE IN CHILD SEXUAL ABUSE CASE AFFIRMED ON APPEAL

DELHI- Delaware County District Attorney Shawn J. Smith announced that the Appellate Division of the New York State Supreme Court affirmed JOSHUA R. CONDON’s conviction and 20-year state prison sentence after deciding the Appeal in the District Attorney’s favor.  

On March 6, 2023, Condon appeared in Delaware County Court to be sentenced on his conviction of Criminal Sexual Act in the First Degree, a Class B Violent Felony. The defendant’s conviction was the result of him sexually abusing an 8-year-old child.  At sentencing, the Honorable Michael F. Getman, Acting Delaware County Court Judge, sentenced the defendant to 20 years of incarceration to be followed by 10 years of post-release supervision.  

The defendant subsequently appealed, arguing that his sentence was unduly harsh and excessive for the crime he committed. Delaware County District Attorney Shawn Smith defended against the appeal, arguing that the 20- year state prison sentence imposed by Judge Getman was necessary and appropriate to hold the defendant accountable for the despicable acts he committed against a young child. 

This March, three years after the defendant was sentenced, the Appellate Division agreed with the District Attorney and held that, under the circumstances, they could not find the sentence was unduly harsh and severe. 

District Attorney Smith stated, “The lengthy state prison sentence imposed by the Honorable Michael Getman was proper, and the Appellate Division correctly affirmed it. This was the last appeal the defendant was entitled to, and the sentence is now final. My office is committed to working with law enforcement to ensure that anyone who abuses a child is sentenced to a lengthy term of state prison.”
